1. Entry Period: The Sweepstakes begins at 12:00 p.m. (CST) on March 22, 2010, and ends at 11:59 a.m. (CST) on February 1, 2011 (“Entry Period”).
2. Eligibility Criteria: In order to be eligible to enter the sweepstakes, an individual must: (i) be at least twenty-one (21) years of age or older; (ii) be a legal U.S. resident; and (iii) not be an employee (full-time or part-time), or an immediate family member of an employee, of Mercedes-Benz USA, LLC (“MBUSA”), any authorized Mercedes-Benz Dealers, the Nasher Sculpture Center or any other business entity engaged in operating the Sweepstakes or selecting the winners of the Sweepstakes.
The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
These eligibility requirements shall also apply to the winning entrant’s guest.
3. How to Enter: To enter the sweepstakes, please visit the lobby of the Nasher Sculpture Center to fill out a Mercedes-Benz survey form or visit the official sweepstakes website at www.DFWMercedesDealersNasher.com. All fields must be completed to enter. Registration is limited to one entry per person.
No purchase necessary to enter and/or win the sweepstakes.
4. Winner Selection/Notification: After the conclusion of the Entry Period, a random drawing of all the entries submitted during the Entry Period will take place to select the winner. The first name drawn that is a valid entrant will be the winner. The winner will be contacted first by email and then by first class mail.
Failure of any entrant to timely confirm his/her address for prize delivery or to comply with any of the within rules will result in forfeiture of prize and, where feasible, an alternate winner will be selected.
5. Prize: One (1) Grand Prize shall be awarded to the winning entrant. The Grand Prize includes: 1) a trip for two, i.e., the winning entrant and guest, to Los Angeles, CA. This includes two (2) round trip coach-class airline tickets from anywhere in the continental United States to be provided by American Airlines, as well as Hotel accommodations at the Fairmont Miramar Hotel and Bungalows in Santa Monica, CA for two (2) nights. These accommodations include one hotel room, double occupancy; and 2) a special tour for two will be provided at one or more Los Angeles area art museum(s), which shall be identified at a later date. Trip must be redeemed and completed no later than May 3, 2011.
The prize winner and his/her guest will be required to provide proof of age, state of residence, proof of identity and execute an Affidavit of Eligibility, Release and Indemnification within the time period specified by MBUSA and/or Nasher attesting that they meet the above-mentioned eligibility requirements and that they release and hold harmless MBUSA, Nasher, their parents, affiliates, officers, directors, employees, agents, authorized dealers, successor companies or participating sweepstakes co-sponsors and/or or advertising agencies, from and against any liability or injury arising from or relating to participation in the sweepstakes, or acceptance or use of this prize. The prize winner will also be required to disclose his/her social security number.
Unclaimed prizes will not be awarded, except as otherwise specified.
Failure to comply with any of these procedures will result in forfeiture of prizes.
6. Publicity and Promotion: Acceptance of prizes constitutes permission to use the winner’s name, voice likeness and city and state of residence for advertising and publicity purposes without additional permission or compensation.
7. Taxes: The prize winner is responsible for all Federal, State and local taxes, as well as all other taxes associated with the prize. MBUSA and Nasher will comply with all Internal Revenue Service reporting requirements.
8. Modifications: MBUSA and Nasher reserve the right to change, supplement and/or modify any of the above-mentioned rules, guidelines and prizes related to said sweepstakes at any time prior to and/or during the Entry Period.
